In this book Professor Smith draws on the technique of ordinary language analysis to probe some of the core issues of jurisprudence. He presents an original theory of law in which the concept of obligation is used to reconcile the assumption that the legality of a rule is independent of the moral qualities of its content with the contrasting assumption that what the law prescribes ought to be done. A further major theme is the nature of judicial decision-making. Professor Smith demonstrates that the law has an internal dynamic structure which enables hard cases to be solved and new circumstances to be dealt with without sacrifice of stability, predictability and consistency. The book explains and clarifies such topics as the rule of law, equality before the law and fundamental rights, and shows their interrelationship to the question of the nature and meaning of obligation. This work is directed to a wide audience of philosophers, jurists, judges and lawyers.
